to low paid teachers, directors and family child care providers working
with children between the ages of 0-5.
- Wage & Hour Law -
Adhering to state and federal Wage and Hour Laws is critical for attracting and retaining child care staff. Because the pay and benefits are often so poor in child care settings, it is important that child care employers understand the appropriate classification of employees. According to NC Labor Department officials, most child care teachers will be classified as non-exempt employees. This means that they are required to be paid at time and a half for hours worked in excess of 40 during the employer's standard work week. Forty-four percent of child care teachers stated that they had worked more than 40 hours in a week. Of these, 53% were not paid at time and a half. This means that in all likelihood many child care employers have failed to adhere to appropriate wage and hour laws. In addition, when employees are asked to work more than 40 hours a week and are not fairly compensated, they are more likely to leave their centers. It is good business practice and good for children to compensate teachers in child care settings at a fair rate.
To this end the Compensation and Education Task Group of the NC Institute for Early Childhood Professional Development created tip sheets related to three wage and hour issues that childcare programs and their staff have said were most perplexing to them. The tip sheets were developed with help from the NC Department of Labor, Wage and Hour Bureau and the US Department of Labor, Wage and Hour Division.
